Estanza Terms of Use
About these terms
These terms apply to your use of the Estanza app for iPhone (“the app”), published by [LEGAL NAME OF ACCOUNT HOLDER], an individual developer based in Spain (“we”, “us”). By downloading or using the app, you accept these terms. If you don’t agree, please don’t use the app.
The app is free. There are no payments, subscriptions or in-app purchases.
What Estanza is and is not
Estanza is a tool for documenting and organising the condition of a property: checklists, photos, issues, meter readings, keys, PDF reports and exports.
Estanza is not legal advice and does not replace a lawyer or other qualified professional. The app does not decide:
- who is responsible for any damage;
- what counts as normal wear and tear;
- repair costs;
- how a deposit or dispute should be resolved.
No guarantee about reports
Reports and exports reflect only what you record in the app. We do not guarantee that a report or export will be accepted as valid or sufficient by a landlord, tenant, agency, insurer, arbitrator, court or anyone else, or that it will lead to any particular outcome, including the return of a deposit.
Capture dates come from the photo’s metadata or your device’s clock. SHA-256 checksums help you check that a file has not changed. They are not a certification, a qualified timestamp or a legal proof of authenticity.
Your content and your responsibility
You own the content you create in the app: text, photos and reports. We claim no rights over it and have no access to it.
You are responsible for:
- the accuracy of what you record;
- having the right to enter and photograph the property and anything shown in your photos, including other people’s belongings;
- respecting the privacy of others, for example by not photographing people without their permission;
- how and with whom you share reports and exports.
No account, and your data stays on your device
The app has no account or sign-in. Your content is stored only on your device. We do not keep backups or copies of your data and cannot recover it. If you delete the app, delete content, or lose or reset your device, your data may be lost permanently. To keep a copy, use the app’s export function or your device’s own backup. How we handle data is explained in our Privacy Policy: /en/privacy.
Acceptable use
You agree not to:
- use the app for unlawful purposes, or to record or share content that infringes other people’s rights (including privacy and image rights);
- alter reports or exports and present them as unaltered output of the app;
- reverse engineer, resell or redistribute the app, except where the law allows it;
- use the app in a way that harms the app, us or other people.
Apple App Store
If you download the app from the Apple App Store, Apple’s Licensed Application End User License Agreement (the “Standard EULA”) also applies: https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. If these terms conflict with the Standard EULA, [LAWYER: confirm precedence wording]. Apple is not responsible for the app or its support. Please contact us, not Apple, with questions.
The app is provided “as is”
We work to make the app reliable, but it is provided as it is and as available, without promises that it will be error-free, always available or suitable for a particular purpose, to the extent the law allows. We may change, suspend or stop offering the app or any feature.
Nothing in these terms limits the rights you have as a consumer under mandatory law. [LAWYER: confirm whether the conformity rules for digital content in the Spanish consumer law (TRLGDCU) apply to a free app that collects no personal data, and adapt this section.]
Limitation of liability
To the extent permitted by applicable law, we are not liable for:
- losses arising from your reliance on reports or exports, or from decisions, agreements or disputes involving third parties;
- loss of data stored on your device;
- indirect or consequential losses.
These limits do not apply to liability that cannot be limited or excluded by law, including liability for wilful misconduct or gross negligence, or for death or personal injury caused by negligence, nor do they affect your statutory rights as a consumer. Changes to these terms
We may update these terms, for example when we add features. We will publish the new version at /en/terms with a new “Last updated” date, and tell you about significant changes in the app or on the App Store. If you keep using the app after a change, the updated terms apply.
Governing law and disputes
These terms are governed by Spanish law. If you are a consumer, this does not deprive you of the protection of the mandatory rules of the country where you live, and you may bring proceedings in the courts of your place of residence.
